Terms and Conditions for Responding to the Manchester Climate Change Partnership Member Survey  

  1. Definitions  

    Manchester Climate Change Agency: Manchester Climate Change Agency CIC a community interest company, registered company number 09761661. References to ‘we’, ‘our’, ‘us’, ‘The Agency’ and ‘MCCA’ in these terms are references to Manchester Climate Change Agency CIC.  

    Personal data: data which relates to an individual who can be uniquely identified from the data 

    Survey: Manchester Climate Change Partnership Member Survey  

    Responding Organisation: the business, charity, organisation or any other body responding to the survey. References to “you” and “your” in these terms are references to the Responding Organisation 

  2.  Parties   

    The parties to these terms shall be MCCA and the Responding Organisation.  

  3. These Terms 

    These are the terms that apply when you submit a response to our Survey. If you are not able to agree to these terms, please notify us at ellie.bradley@manchesterclimate.com 

  4. Responding to the Survey  

    When submitting your response we may only use the data as follows, unless an alternative agreement is made with you: 

    • to use any data within MCCA but not for publication, unless any data from your response has been anonymized or aggregated in such manner that it has the effect of being anonymized unless authorisation for publication of identifiable data has been granted by the Responding Organisation 

    • amalgamating data with information about the Responding Organisation from other public sources 

    • MCCA will make all reasonable efforts to safeguard the confidentiality of the data in your response in line with the appropriate Data Protection regulation  

    All intellectual property rights in your response will be owned by you or your licensors. By submitting your response You grant to us a perpetual, irrevocable and royalty free licence to use your response and any intellectual property rights for the uses set out in these terms.  

  5. Liability  

    We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes, liability for death or personal injury caused by our negligence or the negligence of our staff or for fraud.  

    MCCA has no liability to you in any circumstance for financial or consequential losses. 

    MCCA has no liability to you in any circumstances arising from the content or submission of your survey response to us.  

  6. General

    MCCA reserves the right to change these terms at any point.  

    Severability, each paragraph of these terms operates separately, if a court finds a paragraph unlawful the remainder of the terms shall not be affected.
